Know all men by these presents that wee Andrew Cockerell and Walter Dunne, doe binde our:selves each to ye other in ye penalty and forfeiture of ten thousand pds. of sound merchantable tobo: in caske, to stand to such division of or: land now live on; and all ye land wch: is in joint tenancy or coparternership betweene us shalbe made by Mr. Edward Saunders, Mr. Petr: Presley, Hugh Fouch and John Haynie; and to all and every such matters and things as shalbe by them done or appointed to be done, and wch: of us the sd: parties shalbe delinquent in ye p:omises doth hereby bind him selfe and his exrs. and admrs. to pay ye other or his heires or assignes ye summe of tobacco abovesaid; In Witness whereof we have jointly hereunto sett or: hands and seales this 25th of 8br: 1667.
Wee the above named to make Division of ye land of ye above named Andrew Cockerell and Walter Dunne as followeth: By certaine m:rked trees, ye first of wch: is a white aoke standing in ye line of Sam: Nicholls (neare of Pohickory and red oake) and soe extending northeasterly to a water oake standing about ye head of a pond close below ye house of ye sd: Andrew Cockerell, all yt: part of ye land of ye N: W: side of ye sd: m:rked trees to belong to ye sd. Andrew Cockerell, and ye other pte: south east unto Walter Dun and likewise wee doe oblige the sd: p:ties yt: if either of them or their heires or assignes shall want timber upon his divident, that then it shalbe permittted to fetch timber from ye divident of the other; provided they doe not make a wast by extraordinary making of caskes more then for their owne proper use or otherwise.
