Casey THIS INDENTURE, Made the 26 day of April in the year of our Lord, one thousand eight hundred and fifty one between James Griswold, Clerk and Master of the Court of Equity, for Wayne County, in the State of North Carolina, of the first part, and Wright Casey of said County and State, of the second part ; Whereas, at a Court of Equity, held for the said County of Wayne, at the Court House in Waynesborough [Goldsborough crossed out], on the first Monday after the fourth Monday in March A.D. 1850, it was among other things ordered, adjudged, and decreed, by the said Court, in a certain cause then pending in the said Court, wherein Zilpha Casey, Reuben Casey, Susan Casey, Epsey Casey and Barna & Martha Ann Casey by their guardian Reuben Casey were petitioners, that the land mentioned and set forth in the petition in this cause, be sold by the Clerk and Master of said Court, at the Court house in Waynesborough on a credit of twelve months, and that he give forty days previous notice of the time and place of such sale, at the Court House, and three other public places, in said County :

AND WHEREAS, the said James Griswold, Clerk and Master in Equity, as aforesaid, and party of the first part to these presents, in pursuance of the said order and decree of the said Court of Equity, did on the 20th day of May, A.D., 1850, sell at public auction, at said Court House the tract of land herein after particularly described, having first given forty days previous notice of the time and place of sale, by advertisement, with a brief description of the premises, at the Court House in Waynesborough [Goldsborough crossed out], at the Post Office in Goldsboro at Bowdens, Nahunta and Dudley Depots in said County of Wayne, agreeably to the order and decree aforesaid, at which sale the said tract of land hereinafter particularly described, was struck off to Wright Casey party of the second part to these presents, for the sum of Seventeen hundred Dollars and ten Cents, that being the highest sum bidden for the same :

AND WHEREAS, the said Wright Casey executed to the said James Griswold, Clerk and Master in Equity, as aforesaid, his bond with good and sufficient surety, for the said sum of Seventeen hundred 10/100 dollars, payable twelve months after the day of the said sale, AND WHEREAS, the said Court of Equity, at the full Term, A.D., 1850, at the Court House in Goldsborough, did in all respects confirm the said sale, so made as aforesaid ; AND WHEREAS, the said Wright Casey hath, the day of the date hereof, fully paid up his said bond of Seventeen hundred & 10/100 dollars, together with the sum of (blank) dollars, interest accrued thereon :

NOW THEREFORE THIS INDENTURE WITNESSETH, That the said James Griswold, Clerk and Master in Equity, as aforesaid, and party of the first part to these presents, in order to carry into effect the said sale, so make as aforesaid, in pursuance of the said decree of the said Court of Equity ; also by virtue of the Act of the General Assembly of the State of North Carolina, in such case made and provided, and in consideration of the premises, and of the said sum of Seventeen hundred & 10/100 dollars, principal money, and of the said sum of (blank) dollars, interest, paid at and before the execution hereof, by the said Wright Casey party of the second part to these presents, to the said James Griswold, Clerk and Master in Equity, as aforesaid, the receipt whereof he doth hereby acknowledge, Hath granted bargained, and sold, aliended, released, conveyed and confirmed, and by these presents Doth grant, bargain, and sell, alien, release, convey and confirm, unto the said Wright Casey party of the second part, and his heirs and assigns forever, that certain lot or parcel of land, situate, lying, and being in said county of Wayne, bounded and described as follows : Beginning at the mouth of the Big Branch and on the run of Bear Creek, to a Stake in James Parks line, William Smith (now Mark Smiths) line, Flowers Corner, Matthew Caseys corner, near the division of William Caseys land then with Mathew Caseys (now Henry Smith's line), Plank Branch, containing 350 acres.
